Whether USCIS can find out or not depends on their IT systems.
I am 80% sure that you need to be present in US when you are applying for 485. Better safe than sorry. What you can do is - prepare all the documents and file it as soon as step in to this country.

Got RFE (sept 10, 2010). was working on RFE (medical report needed)..
Today I spent around $300 to start medical exam report. I've to still to do lab work and may need x-ray. I was working with my swollen arm and got this message..
Your Case Status: Card/ Document Production On September 22, 2010 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

Now I have to wait.. I will skip tomorrow's lab :confused: and talk to my attorney. Confused yet happy

I received a phone call (WOW!) from a sweet lady from CIS Ombudsman's office. I sent letters to his office and in the letter I mentioned my cell #. Anyway she wants a real person who got deniel. I told her that my friend got deniel (IVens are my fried). Anyway, she sent an email too after I asked her to give her info so that my friend can send her his case details. Unfortunately, the email I received shortly after the conversation, looks like general and does not have her ID. Please PM me if you like to hera more about the phone call.

I really want to hear from the people who were ready for the protest in DC. This is a good opportunity to explain what has happened and the root cause of the issue.

How long are we going to hang in there? :mad: Thanks everybody for support and advice, but, there is a problem here. I am mad at USCIS, not the supportive people here. I am a concurrent filer, I don't even know if my package was lost, if it was transfered or not. Or, if it was tranfered if it was a successful transfer. Every other implication aside, it is worth a lot of money. :eek:
May be I am too negative, but, my J-1 waiver package was lost back when it was done by paper. Literally lost (!), although I could locate the person who signed it in. My SS#, all background information, a check showing my checking account were in it. I told them, my privacy information is in it after I applied for the waiver again. I asked them if they could look for the envelope and destroy it. They "nicely" told me I have no rights at all to make such a request. I asked them if they have a system of destroying people's private information if it is no longer use, they said no.
These should be our simple rights as a people who pay taxes in this country, although we are not residents yet. We can go to court for an everyday dispute, but at USCIS no rights.
Anyway, thanks for involuntarily sharing.

Hopefully things may look better with the new bill sponsored by Arlen Specter.
The bill looks good but how do we know that it is this bill which will be discussed and not the other bills sponsored by senator hagel,mccain etc..

You stand is understandable, but I still will urge you to join me. It is of course not illegal but unfair towards the people already in EB2 line. If there were no limits on visas, it will not have been an issue to begin with. Think about the depth of the issue.

There is popular agreement among the folks that filing multiple I-485 is fine (if one sees a need) but file only one set of EAD/AP. My concern here is relating to which I-485 to choose for filing EAD/AP. Wisdom says choose the one with I-140 that is approved or whichever has greater possibility of approval. Say, I have both I-140's Pending and file EAD/AP with one of them. In case this 140 gets denied what is the fate of EAD/AP that is Approved. Will these become obsolete even if the status of applicant is AoS as a result of other 485?
If the second 140(**) gets Approved before the 140(*) on which EAD/AP is currently filed/Approved, can I renew/Start filing EAD/AP on the approved 140(**)

I called vonage cs too...she confirmed the 5k limit exists for residential vonage world program. Minutes are counted only against outgoing calls. 5000 min is approximately ~ 2.6 hours per day for 31 days which I think should be sufficient, unless you are running some kind of a business from home.
In a case the 5k limit is nearing or has exceeded, vonage will send an email alerting us to this, at which point we will need to talk to their usage management team. This team will evaluate the situation for us - mostly that translates to this - if we exceed this again, they may make us get the next higher premium plan.

Unfortunately we are all caught in it with only solution to fix is time travel and kill the beast in infancy. There is vested interest by the Govt and Banks to lend because that's the only way money is created. That explains constant rate cut cycle and stimulating artificial growth. The entire monetary system is hijacked by banks. The debt to ordinary people drives the economy and people pay that debt and interest a good part of their life. Thus collapse of big banks could lead to eventual meltdown of the system, and no wonder govt keeps bailing them out.
In the end personal level frugal living and debt free people are constantly punished by taxing interest like ordinary income and no tax breaks. On the other hand big over leveraged spenders are rewarded with big tax breaks. Why ? Because it allows the well-oiled machinery to work.
In last 10-12 months, this overworked (overstretched) machinery broke down because the debt (and interest) is no longer paid back. Banking system of the entire countries start to fail (Iceland, Latvia, Hungry...). What happens next is anybody's guess, but we will be collateral damage, mine and your savings will be eroded by diminished buying power due to currency printed to bail out the fundamentally flawed system.
The sharp decline in moral and ethics is a direct result of entitlement mentality and welfare society. People feel that they deserve everything without having to pay it back and everyone who is better off must be evil. They forget that simple hardworking people can be rich by simply living debt free and with in the means.
Finally the money from debt driven system might survive but not without huge decline in standard of living, a massive recession and permanent shift away from material possession as a central theme of life.
