I sent a hand written letter to the President and CC'd it to CA IV PO BOX. and I feel a lot better after writing it.
I have also sent a personalized hand written letter to the local Congressman. I will set up a meeting once I get a positive response or in the next few weeks, whichever is earlier.

Guys this is a revision to the July Visa Bulletin. Meaning, even if the revision happens on July 29th to the July Visa Bulletin, it holds good for entire july.
This is not August bulletin.
Looks like people have misconception, that if their file goes to USCIS on July 2nd and visa bulletin is revised on July 3rd or later date, then they are safe. It is not so.
If at all if there is a change to the August bulletin it holds good for August and not to July bulletin.
Pls let me know if my understanding is wrong

Also what did you write to them in the e-mail. If you can share that would be great. I am still waiting after becoming current in Sept.

I got one more email with the update (this is third email with the same staus "CPO"). This time I have SLUD on EAD and AP also. Here is the email...

I'm also in same situation only difference is my visa stamped in PP is expired (Jan06), but has H1 till Jan 2009. I'm planning to visit India in Feb07 and return on AP. As I read in other forums that H1 will be valid and we can file for extension (even Cornin INS Memo (5-16-00)) memo says that. My attorney also confirmed that.

I would suggest you to get h1 your visa stamped from India and enter on h1 and not on AP. Don't even show your AP to the immigration inspector at the POE.

Well, Not too bad, it has been acknowledged and now will definitely be picked up by the press as the flowers will be forwarded to injured service members at the Walter Reed Army Medical Center and at Bethesda Naval Hospital.

Is there some master list of companies that have been filed against ? Do you know of anyone on this list that have done so and won ?
What will that accomplish really ? I dont know if working for this place will be a good idea anyway after filing a suit against them... but OTOH if it helps other people or at least if its out there on the net, so other companies wont get his brilliant idea....

EB2 I, PD 22 Dec 2005 filed in NSC.
Lawyer sent an email on 8/3. I opened SR on 8/9. Not sure which one worked.

Hi,
My labor (EB3) and 140 were approved a while ago.My company has sent H1B extension for three years in Feb 07.There was a query requesting for additional evidence from USICS in Apr 07.They are requesting lot of my company info and nothing about myself.My Company is taking its own sweet time to respond.Now I am eligible to file 485 as per the latest June visa dates for EB3.My question is could I file 485 when H1b extension is pending.My previous I94 expired on May 07.Please help as it is urgent.If the visa dates move back again then it will be horrible.My Company didn't file during concurrent filing and has eaten 2 years of my life and now they may use this to further hold me..any help will be appreciated.

in mumbai, also you need to enter the details of petition online (petition number, expiry date and petitioner name) while booking appointment.. and you need to submit all documents before 5 working days.. (in some cases they mention 3 working days)
I havent taken my appointment yet so dont know if that would be the case even for Delhi. But in Mumbai..r they asking to fax the documents (like I-129, I 797A, LCA etc) to them prior to the interview?

Well, all the jobs you mentioned in your message now falls in Zone 4 i.e. Eb3.
Only option that person may have now is to change career altogether in the fields where desi consulting companies do not operate.
Job Zone 4 does not automatically translate to EB3. Even though the title maybe EB-3, if the requirements exceed normal requirements for jobs in Job Zone 4 then after a (successful) business necessity audit the candidate maybe able to file in EB2. After all I don't think DOL is that brain-dead (yet?) to say that somebody with 15 yrs exp is the same as somebody with 1 yr exp although they have the same job title (E.g. Software Engineer title at Google generally has more experience and education than a software engineer title at a desi consulting company even though both fall in job zone 4
Solar power here has inadvertently opened Pandora's box in the process of trying to solve a genuine cause for concern. For most IT people it is going to be very tough to get EB2 classification (especially if you are just out of school and have decided to apply for a green card). It is better for them to look out for research positions and apply under Computer Scientists as this will atleast enable them to apply under EB2. Is this a good thing: If you are non-IT yes, if you are IT no as it just convoluted the process even more.
