I dont know about other members but it is hard for me to blv that IIT's and IIM's will come to US for a masters degree coz they could not find a job in India or they could not get an admit in a master's program.
If that was the case people would have stopped going got IIT's/IIM's. Why will someone work so hard to get to the top most program - to not get a job and then pursue MS from US OF A????

Even if PD is not current, I believe you can convert CP to AOS. Check Murthy website or talk to them.
If this cannot happen for you then you should look for a change towards this provision.
But EAD & AP fro CP is not going to fly administratively. As others have stated it is contradictory.
Guys let's come together on this--everyone has some good points to share, from every angle. As a CP filer myself, I want to say that job stability concerns are very valid for CP filers, who are haunted by last summer's greenlight and today's major retrogression. The landscape has changed for everyone, for both queues. From personal experience of being in the BEC backlog, being too early for PERM and too late for concurrent filing, after 5 years of being in this process and seeing the further backlog ahead, yes I was willing to pick CP (even though I would be giving up my ability to work as the spouse) because it looked like things were finally moving last summer. The option was there for people to choose, and nobody knew the dates would roll back so painfully again. Equally, I also want to point out that IV IS about everyone and these marvellous efforts IV continues to put together and inspiring in all of us, are beneficial to all because the overall goal is to ease the backlog which is holding everyone back. Now that this discussion has happened we are all aware of the new problem that is facing CP filers in severly retrogressed countries. And it is better that this is brought to light as we continue forward. Please everyone, continue supporting the letter campaign and let's be united and discuss these issues with respect for one another.

AILA and all the immigration lawyers and many employers threw a hissy fit when DOL wanted to shut down labor substitution.
They lobbied hard at DOL to allow the continuation of labor substitution. IV has tried to get DOL to eliminate labor substitution or at least make it such that the Priority date is not the labor filing date but the 140 filing date. Allow labor sub with PD = 140 filing date will solve the problem of cutting in line and getting ahead in an unfair manner. Thanks Snathan for bringing up this issue.
I personally suffered due to this visa stamping. I was stuck in Delhi for four months due to administrative processing, almost lost my job, lost apartment, lost lot of money and now I am scared to go back for stamping again. My wife and I had to miss my father in law's funeral due to this fear.
I know few other folks who have been in similar situation and I can contact them to share stories.
I am willing to contribute both time and money for this initiative.

Guys, these are all good suggestions.
However, it is a fact that EAD/AP etc are given in certain circumstances only. Eg to students on OPT, applicants for Adjustment of Status etc. I dug through INA and it specifically says that the Attorney General shall provide Work permits to applicants waiting for Adjustment of Status applicants. I don't have the time to dig through again and provide a reference, but in any case:
USCIS can't just go give EADs to whomever they please. Legislation is required to authorize these benefits. Students are allowed to work on OPT because Congress legislated that they may, not because USCIS thought it was a good idea.
The bigger point that I am trying to make is that whether we get EAD/AP as a derivative of I485 filing even with retrogression, or as a beneficiary of an approved immigrant petition, is immaterial. Legislation is required to bring about these changes.
If you think about concurrent filers in situations where USCIS takes a long time over immigrant petitions, then you are better off with EAD/AP being a benefit of 485 filing rather than waiting for the I140 approval. You get EAD/AP in a couple months instead of waiting for i140 approval then filing for EAD/AP.
At this point, I am going to go back into hibernation. Thanks.

However, prayers might be good only for that. What I say below is directed to people in general, and not to you. So, please don't get offended. I am not suggesting in any way that you are not making any concrete efforts to support IV.
I bet a lot of people are praying very very hard for their greencards.
I would like to request them to invest in concrete steps. Give monetary support to IV. Form, or join, a local state chapter. Go meet a lawmaker or his staff. Call them up and talk to their staff. Pray only if you have done all or some of the above. As they say, God helps those who help themselves. Keep up your end of the bargain, and then ask God (of the Holy Flying Spaghetti Monster, or whatever) for help.

2003(Mar) - PD
2005(Sep) - LC approved
2005(Dec) - I-140 approved
2007(Apr) - Can file AOS/EAD now
The secret.....

To those who don't know, it took Noah 120 yrs. of faith and hope to built his arc when he was asked to, by Our Heavenly Father.

Sorry to hear about your personal life. If you and your wife agree for filing a divorce petition together, you can file for divorce by mutual consent in India. Both of you have to be present in the court when you file. The judge will decide on the case after a wait time of six months and you may have go back again for the final judgement. There is an one-year separation time that is required before you can file for mutually consented divorce in India. If you are already separated for more than a year, this is the best route.
If not, like some one else mentioned, you can file here but, some states like NY don't have provisions for divorce based on mutual consent or irreconcilable differences. So, it will take up to a year sometimes. It is perfectly legal and valid to get a divorce in the U.S if both of you have signed the petition and have been present at the court.
Your PD is Dec 2003 and so, you have time especially with all the projections that the EB3 quota (India) may retrogress.

Plassey, regarding your thoughts and comments let me tell you something "GC is not the best thing in the world, for which one has to be so depressed and cry in bathroom". If you have talent and belief you can survive in any condition. I am not a preacher nor a saint, but nobody can stand such insolent reply from you. Good luck to you for the rest of day.

it probably means.. they are opening each and every mail they have recived and checking if the docs are in order or not..if they are.. they file it...else they send an RFE...
i dont understand..how someone can be so f@#$% dumb as not know this simple procdure..
there are so many posts..i got a LUD what not.... its annoying...
its like.. USCIS touched my lu(n)d..will i get a GC now..

If I were a person of Latino origin, I will be very angry with folks who assume that all Latinos are illegals.
And to all the guys replying to my earlier post that such laws will increase racial profiling etc. In my opinion laws to make illegal immigrants' life difficult is basically good for us. I totally agree that non-white folks will be inspected by cops during the initial period of enactment of the law. What's the big deal about it. We will be stopped by cops. They will check our papers and will leave us, won't they? The same is true for Latinos (if they are here legally). Like I have written earlier, I have been living in a county which has implemented 287 g for the last several years and I NEVER had any issue with this. I have personally met the county chief of cop who has been a very vocal supporter of the program and he did not immediately arrest me.
The cop will fine you if you did not have the insurance card; under the present bill, the latino has a chance of being deported and not fined......huge difference!
