    If I were you, I would call the cops and report this immediately. One can say that you are calling for the protection of your family because a similar incidence of a fake ICE officer took place recently. They could easily find out if that was a real guy or some hoax.

    This is my first post so forgive if I am not in the right place,
    But I have situation where in I need your inputs to decide.
    I am working at a clients place and they willing offer me a full time position.
    My Labor is approved Oct 2007 and Filed for I-140 receipt pending.
    In this situation should I change my job or should I wait for I 140 to be approved or wait till I apply for I 485 , but as you know the priority dates have retrogressed for EB2 and I heard that they will be unavailable shortly.
    I always wanted to get a full time right from my Masters but ended up as a consultant as I had to get my H1 done.
    Please Advice!

    You cannot change employer and keep I-140 if you have not filed I-485 yet. You will have to start the GC process anew if you change the jobs now. So wait untill you apply for I-485. Wait 180 more days after that and you are free to change jobs if your new job is same or similar to your current job.

    I really thank IV for the support extended so far. I am praying to god and hoping that this matter is resovled else this will seriously affect my small family of me, my wife and my one year old for absolutely no fault of ours.
    I am also working with the law firm and they are trying to reach out to USCIS to try to rectify this grave mistake.
    The only thing that really worries me is that in the withdrawl notice from USCIS it says

    "'As a result of your request, your application is considered withdrawn, and it will recieve no further consideration by USCIS. There is no appeal to this decision.'"

    I will keep the forum updated on any developments

    "'As a result of your request" - the fact that you didn't request it negates the basis for their action - so i think you will be fine

    There are thousands of IV members in CA. Please book your tickets now. Yes, it is thousands of miles to DC and on a work day too but as I said we have one chance to voice our concerns. We are not going to get another chance like this anytime soon. It looks like we might have to fly in a few hundred people because DC appears to be sleeping.

    To begin with let me say that I have earned my masters from the US but still I'm not in favor of this idea simply because getting a masters from the US does in no way prove that US needs us more than others (in light of EB law), or we are any smarter or more capable than people who did masters or even under grad from their home country..

    Besides this will further divide the community which as is divided.

    Just my 2 cents.

    Is this still an active topic? or its dead? Are there people with US Master - STEM who are willing to come forward?
    I am just trying to gauge this? To me, looks perfect candidate for piece meal while waiting for CIR, justification could be same as 20K quota for H1b, keep US educated in the country and keep contributing to US economy & society. It has two benefits, a) direct to people who have US Master, b) there will xx less number of people in front of who don't qualify for this so their turn will come sooner.

    But the nature of the job responsibilites are same but i believe the Job code may change b'cos of the Title.



    I believe it is not a problem, I have read in other threads. but I would suggest lot of attorneys are only taking 300 or 500 dollars to file aC21. it is worth spending.

    Mark Kirkoreiean's (or whatever his name is) thesis is that not everyone who gets a green card through EB is a genius, and that is not good for America. "Einstein" here doesn't understand that it takes more than a genius to make a company successful, and thereby create more jobs for your average Joe. If you are in the business of developing cutting edge technology, you certainly need some very smart people in your labs. But the guy who actually gets the product out of the door is your moderately above average skilled employee who knows how to get the job done. The whole argument that America needs the "best and the brightest" only is terribly flawed. And what better example than this Kericorien (or whatever his name is) character himself. In his testimony, he suggests that EB should be limited to EB1, and that too, to about 15K. Great, these 15K people will be able to do the job of the 500K gainfully employed individuals whose EB application is pending. Super! Good luck with selling that Mark.

    After reading what Mr Mark had to say i must say i m furious but at the same time i understand what he is trying to do viz Misguide!

    Folks like Krikorian thrive on donations made by misguided people (in the name of not-for profit and enticing them with tax exemptions). You don't have to be an "Einstein" to figure that out but you have to be at least EB3 category :D

    Reminds me of the Simcox guy of the minuteman project who raised millions and fooled a lot of people in the name of border fence which turned out to be a cow fence at best.

    And now a little prayer to calm down Soul!

    On June 25th, President Obama is convening a bi-partisan meeting to discuss the prospects for moving on comprehensive immigration reform later this year. If he asked me about the politics of immigration reform in this economic climate, this is the memo I would send to him:

    Mr. President, with so many challenges facing America, is it too much to tackle immigration reform this year?

    Reform advocates point to the pledge you made on the campaign trail, to make immigration reform a "top priority in my first year." Yet skeptics argue that the economic crisis makes your campaign promise moot. They believe you should delay immigration legislation and focus on the economy and your other legislative priorities. While addressing immigration may seem to be heaping another issue onto an already-full plate of priorities, there are four compelling reasons for you to move forward with reform this year.

    First, the public support for immigration reform is growing stronger notwithstanding the conventional wisdom advanced by the political class. For a big majority of Americans, the failure to address immigration is a symbol of Washington's failure to confront and solve tough problems. Comprehensive immigration reform - the key elements of which require strong enforcement at the borders and in the workplace, coupled with a mechanism for unauthorized immigrants to get legal, learn English and pay taxes - is viewed by the majority of Americans as the most practical approach to addressing this complicated problem.

    And in this economic downturn, voters are actually more supportive of immigration reform than at any other time. As pollster Celinda Lake tells it, "voters are very focused on finding solutions to our problems. They support comprehensive immigration reform as a practical, common-sense solution and have no patience for politicians who want to point fingers and score points rather than fix the problem."

    The evidence for this point of view is growing. A Washington Post/ABC News poll showed 61% support for giving undocumented immigrants the right to live in the U.S. "if they pay a fine and meet other requirements," a 12% increase since 2007. The Pew Research Center recently found that 63% of respondents supported a pathway to citizenship, up 5% from 2007.

    In polling conducted in May by Pete Brodnitz of Benenson Strategies for the organization I direct, 64% of voters support comprehensive immigration reform before it is described, and a whopping 86% support comprehensive reform after it is described. In response to a head-to-head question that pits comprehensive reform against the enforcement-only approach favored by most Republicans and some conservative Democrats, comprehensive wins 67% to 31%. Among those voters who describe themselves as undecided for the 2010 Congressional elections, they not only favor comprehensive reform at the same levels as Democratic voters, by a 69% - 28% they want their elected leaders to tackle immigration reform this year.

    The second reason you should move forward is that your commitment to move on immigration reform has created enormous expectations in the Latino community. Your campaign promise was a galvanizing factor in motivating Latinos - especially Latino immigrant voters - to turn out in record numbers in 2008 and swing decisively to the Democratic column. These new voters helped flip at least four states that voted for George W. Bush in 2004 to Obama states in 2008 (Florida, Colorado, New Mexico, and Nevada).

    While some like to point out that polls of Hispanics put issues related to the economy as higher on the priority list than immigration reform, the fact is that Immigration reform is a defining issue for Latinos the way civil rights is for many African-American voters, choice is for many female voters, and Israel is for many Jewish voters. For example, in a recent poll of Latino voters conducted by Bendixen and Associates on behalf of America's Voice, 82% called the issue personally important and 87% said they would not consider voting for a Congressional candidate who favors forcing most of those in the U.S. illegally to leave the country. Moreover, expectations are sky-high: three out of four Latino voters expect you to keep your pledge to move on immigration reform in the first year.

    The third reason you should move forward is that fixing immigration is a critical component of fixing the economy. Immigration reform will benefit American taxpayers by requiring workers and their employers to get legal and comply with their tax obligations; it will benefit American workers whose wages and working conditions are depressed by unscrupulous employers who exploit unauthorized workers; and it will benefit law-abiding employers currently undercut by bad-actor competitors by significantly reducing the incentive to underpay workers and pay them off the books in order to win business. As for increased revenues, get this: a Congressional Budget Office study of a legalization component included in the 2006 McCain-Kennedy bill projected increased revenues over 10 years totaling $66 billion. Not bad at a time of squeezed budgets.

    Finally, the moral stakes are high and getting higher. How we as a nation deal with illegal immigration has become a defining moral issue for our nation. Ultimately, the question we face is this: are we going to allow hardliners who want nothing less than the expulsion of millions of immigrant families already living in our communities to dominate the debate? Or are we going to live up to our tradition as both a nation of immigrants and a nation of laws and write a new chapter in the American story of how including "them" makes for a stronger "us?"

    Immigration reform will not be easy, and yet, this is the kind of big issue that led you to proclaim the fierce urgency of now and run for President.

    This is your kind of fight, Mr. President. History is calling.

    All,

    This is a very good news that I have heard since last July. I am not sure if MBA's will also be condidered as part of this bill. I have paid around $90 K from my pocket, to get my MBA from Duke.

    If that is the case then I would recommend that anyone who has any kind of support from their employer (or even without it) should get a masters degree as soon as possible. This will not only increase our value but will also shorten the queue.... just my 2 cents.

    I doubt this law will cause any trouble. For analogy, there are laws around carrying current insurance papers. Once I didnt have my current insurance, since every six months new ones get mailed and I forgot to keep them in the car. I showed the police officer my previous expired insurance and mentioned that the insurance-id is the same. He accepted it and asked me to carry the current copy in future.

    Oh, they were about to trap me into joining them, I did an interview through them back in 2001 the client wanted to hire and when I told them I am not interested, they started forcing me, then they sent a employee to my apartment to bring me to their place, my roommate joined them and he also had a tough time, he later transferred his h1 to a middle client and after that both me and my roommate had to constantly workout strategies to get his w2s, paystubs etc.... they gave him a real tough time
